SOFTWARE  LICENSE  AGREEMENT

For viewing this Learning Sites disk containing the Ancient Greece: Town and Country educational package prototype and the Learning Sites Projects demonstration files.

This Agreement is made between Learning Sites, Inc., a Massachusetts corporation, having its principal place of business at 151 Bridges Road, Williamstown, Massachusetts 01267-2232 (the "Developer"), and you (an entity or a person; the "Licensee").

1.  Scope of License

By this Agreement, Developer agrees to license to Licensee for demonstration and educational purposes only the following materials: (1) Developer's Ancient Greece: Town and Country educational package Beta version, and (2) Developer's selected project demonstration files delivered on CD-ROM (the "Software").
 

2. Grant of License

2.1  For Licensee's Internal Use.  Developer hereby grants to Licensee a nonexclusive, nontransferable site license to use the Software for evaluation, demonstration, and educational purposes only.

2.2  Other Provisions.  Licensee agrees that it will not disassemble or decompile the Software or any portion thereof, including for reasons of error correction.  Neither may Licensee make any derivative works from the Software.  Licensee may not copy the Software whole or in part except once each for reason of backup and installation on premises.  Licensee may copy the files onto a medium other than this CD-ROM for purposes of demonstration.

2.3  IN THE ABSENCE OF COMMUNICATION BY LICENSEE TO THE DEVELOPER TO THE CONTRARY, ACCEPTANCE OF THE PROVISIONS SET FORTH HEREIN SHALL BE PRESUMED TEN DAYS AFTER DELIVERY OF THE SOFTWARE.
 

3.  Property Rights

Ownership of the Software.  All right, title, and interest in and to the Software and its source code shall remain with Developer, and Licensee shall neither have nor obtain any right to use, modify, copy, or disclose the Software except as expressly provided for in this Agreement.  Licensee further agrees to preserve and respect any notice of copyright or other proprietary right of Developer included with the Software.
 

4. Warranty

4.1   For Failure to Perform.   For thirty (30) days after delivery of the Software to Licensee, Developer warrants that the Software will perform substantially as specified in the installation instructions.  If the deliverables fail to perform as warranted, Licensee shall provide written notice to Developer, and Developer will in a timely manner make reasonable efforts to remedy the problem.  Developer, however, shall not be responsible for any failure of the deliverables to perform if such failure arises from the failure of Licensee to use the deliverables as set forth in the Agreement.  Developer does not warrant that the functions contained in the Software will meet any specific Licensee requirements or that the operation of the Software will be error free.  Licensee agrees that its sole and exclusive remedy hereunder will be limited to Developer's efforts to repair stated above.

4.2  Additional Support.  Any technical support beyond that provided in Section 4.1 shall be by separate agreement and in accordance with Developer's professional fee schedule then in effect.

4.3  Limitation on Liability.  Licensee understands that, except as may be set forth herein, any modification of the Software by anyone other that Developer or any failure to use the Software as set forth in this Agreement will void the warranty set forth herein.

THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT WILL DEVELOPER BE LIABLE TO LICENSEE (OR TO ANY THIRD PARTY FOR THIRD PARTY CLAIMS AGAINST LICENSEE) FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING ANY LOST PROFITS AND LOST SAVINGS, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
 

5. Term and Termination

This Agreement shall be effective until terminated by mutual consent, or by election of either Developer or Licensee in case of the other party's unremedied material breach.  In case of any termination of this Agreement, Licensee will immediately return the items specified in Section 1 to Developer without making any further copies.
 

6.  General Terms

This Agreement supersedes all prior agreements and understandings, including oral representations, between the parties relating to development of the Software, and Licensee's license granted herein is intended by the parties as the complete and exclusive statement of the terms of this Agreement, and may be modified only in writing by the parties.  In case of any discrepancy between this Agreement, and any other documents, the terms of this Agreement shall prevail.  Waiver of breach of any provision of this Agreement shall not be deemed a waiver of that provision of or any other provision.  The remedies herein reserved shall be cumulative and additional to any other remedies in law or equity.  This Agreement shall be governed by the laws of the Commonwealth of Massachusetts and shall inure to the benefit of the parties, their successors, administrators, heirs, and assigns.  Sections 3, 4, 5, and 6 shall survive any termination of this Agreement.
 
 
 

SYSTEM  REQUIREMENTS  AND  INSTALLATION  INSTRUCTIONS

 

The following section explains:

(1) what the system requirements are to view the material on this CD-ROM; and
(2) how to install and run the software included on this CD-ROM.

Please note that the Ancient Greece: Town and Country educational package is a beta test version of the material.  The version does not contain the anticipated full dataset of the final product; nor is the user interface complete.  Items in green text are not yet fully implemented.

The computer system requirements for successfully viewing the Software are:

(1) General minimum system requirements for viewing files other than the animation and the virtual reality portions of the Software -- a Pentium-based PC, with a 166MHz or faster processor (233MHz recommended), with 48Mb RAM (64Mb recommended), and a 2X or faster CD player.  Microsoft Windows95, Windows98, or WindowsNT is also required.  Your monitor must be set for 16-bit color minimum (that is, High Color or 64k color); anything less than this will not display the full palette of colors required for viewing.  In addition, you must have Netscape Navigator version 4.05 or higher, as all our files are viewed in a Web browser format; Microsoft Internet Explorer will NOT provide the same quality nor consistency and is therefore not recommended.

(2) The virtual reality portions of the Ancient Greece: Town and Country  prototype and Learning Sites demo projects -- The virtual worlds Netscape Communicator and the Silicon Graphics Incorporated (and Platinum Technology) Cosmo VRML Viewer to display the text, pictures, and 3D models of the archaeological sites.

If you do not already have Communicator version 4.05 or higher, then you will need to upgrade or change your Web browser.  Netscape's Web browser software may be downloaded for free at: http://home.netscape.com/download/index.html.  Download this file to a temporary directory on your hard drive; double click on the executable in your temporary directory to install Netscape Communicator on your system. If asked whether to install the optional media files, accept this option--this will install the Cosmo VRML Viewer plug-in.

Please note that our virtual worlds (and any true virtual reality software utilizing VRML or other world-building tools) cannot run on Apple or Macintosh machines.  This is a function of the internal processing capabilities of those computers.
 

SPECIFIC  INSTALLATION  INSTRUCTIONS

To use the Ancient Greece: Town and Country and Learning Sites Demonstration Materials

1) Be sure you have the proper hardware configuration.
2) Be sure you have installed the necessary adjunct software.
3) Open a Windows Explorer window.
4) Go to the drive containing the Learning Sites CD-ROM.
5) Choose either the Ancient Greece: Town and Country prototype or the Learning Sites projects demo.

 a) For the Ancient Greece: Town and Country prototype, double click on its directory, then double click on the subdirectory called "AncGrT&C_HTMLpp" and then open the file: 01-AGTC_CvrPg.htm
 b) For the Learning Sites projects demo, double click on its directory and then open the file: LSI_CD_home.htm
6) No Learning Sites files will be added to your hard drive, each demonstration runs directly from the Learning Sites CD-ROM.  If, however, you find that the load time is too long or that the virtual worlds are too slow, then your CD-ROM player may be too slow to output large graphics files. In that case, we suggest you copy the entire CD-ROM to your hard drive under a new "LearningSites" directory, and run from there, which will speed up access times.

NAVIGATION  TIPS

INTRODUCTION

The following sections describe how to use the tools provided by the Cosmo Player VRML Viewer.

Unless otherwise specified: "click" means press the left mouse button and release it; "downclick" means press the left mouse button and keep holding it down; and "double click" means press-release, press-release the left mouse button in rapid succession.

Generally, a virtual world and associated text and graphics appear in a browser window with two or more frames.  Usually, an upper or right-hand frame contains the 3D model (or models); other frames contain descriptive text, 2D graphics, and indexes.  At times floating windows will appear on top of or behind the main window.  These provide supplemental information about the site or about specific items in the virtual world.
 

HOW TO NAVIGATE IN A VIRTUAL WORLD

To scroll the text in a text frame, click in the text frame and use the arrow keys, or use the mouse to scroll the slider on the side of the window.

To navigate in a 3D model frame, please consult the Cosmo Player VRML Viewer Help files, by clicking on the '?'  icon in the lower right corner of the navigation dashboard.  These files will explain the meaning of the dashboard controls.

You then may either:

    * Use a mouse with the Cosmo dashboard controls, or

    * Use the arrow keys on the keyboard to move.

To use the keyboard arrows, first click on one of the Cosmo Player navigation tools, then click anywhere in the virtual world (clicking in the frame containing the virtual world, activates that frame), and then use the arrow keys to move.  The 'up' arrow moves you forward in the scene; the 'down' arrow moves you backward; the 'left' or 'right' arrows turn your head to the sides.  Pressing and holding down the ALT or CTRL keys with the arrows changes the type and direction of movement or tilt.

Should you find yourself upsidedown or in any other position that is undesirable, you may click on the "Straighten" button to the right of the directional controls, and this will realign your viewpoint angle to horizontal.
 

Using Predefined Viewpoints in the Virtual World

We have defined specific locations in the models that are interesting.  To go directly to one of these locations, click the Viewpoint bar on the left side of the navigation dashboard. This will bring up a list of viewpoints. Click on the viewpoint to which you would like to travel.

Please note that the models are not complete; thus, you cannot walk everywhere, nor are all the surface textures final.
